Hmm. In all honestly though, the homebrew scene (whilst awesome, don't get me wrong) is completely dwarfed by the number of people using the flash carts to pirate games. It's one of those catch twenty-two situations in which to rid themselves of one evil, Nintendo (and co.) have to sacrifice legitimate users.

All in all, I'd say they don't have much choice. I expect that developers/publishers are putting Nintendo under quite a bit of pressure to pursue legal action judging by the list of companies involved.
